The Commission takes the view that the General Court, in paragraph 174 of the judgment under appeal, rightly held that in-house lawyers and external lawyers are clearly in very different situations, owing, in particular, to the personal, functional, structural and hierarchical integration of in-house lawyers within the companies that employ them.
La Commission estime que c’est à bon droit que le Tribunal a conclu, audit point de l’arrêt attaqué, que les avocats internes et les avocats externes se trouvent manifestement dans des situations différentes, non comparables, du fait notamment de l’intégration personnelle, fonctionnelle, structurelle et hiérarchique des premiers au sein des sociétés qui les emploient.
