the selection of species to be planted, of areas and of methods to be used shall avoid the inappropriate afforestation of sensitive habitats such as peat lands and wetlands and negative effects on areas of high ecological value including areas under high natural value farming.

8. The High Representative shall establish the selection procedures for EEAS staff, which shall be undertaken through a transparent procedure based on merit with the objective of securing the services of staff of the highest standard of ability, efficiency and integrity, while ensuring adequate geographical and gender balance, and a meaningful presence of nationals from all Member States in the EEAS.

There are many excellent safeguards included in the Bill, including the carefully constructed composition of the selection committee, designed to achieve both a high level of legal knowledge and political impartiality, as well as the requirement for approval of the appointment by a parliamentary committee — but throughout the whole process, the choices and discretion are confined within the parameters set by the Minister, namely his or her list of 10 names.

Although it declined to comment on whether Parliament could unilaterally establish other forms of selecting senators that would not involve direct elections, given that the Court felt it lacked specific examples of the alternative methods, its opinion is implicit in the judgment that any alternative means of selecting senators should not interfere with the essential characteristics or fundamental features of the Senate.10 (A more detailed discussion of the Upper House Reference is provided in the Commentary section below.)
