La Commission partage le point de vue des parties prenantes sur l'importance de la liberté contractuelle ; elle a déjà fait valoir, dans son plan d'action, que « la liberté contractuelle devrait être le principe directeur [d'un tel droit des contrats] » et que, par conséquent, « les parties contractantes devraient (...) avoir la faculté d'adapter les règles spécifiques de ce nouvel instrument en fonction de leurs besoins, dès qu'elles l'auraient choisi comme droit applicable au contrat ».
The Commission shares stakeholders' view of the importance of the principle of contractual freedom and had already underlined in the Action Plan that the principle of "contractual freedom should be one of the guiding principles of such a contract law instrument" and that consequently " it should be possible for the specific rules of such a new instrument, once it has been chosen by the contracting parties as the applicable law to their contract, to be adapted by the parties according to their needs".
