Néanmoins, les juridictions ne devraient pas pouvoir soulever l'exception d'ordre public afin d'écarter la loi d'un autre État, ni refuser de reconnaître ou d'exécuter une décision rendue, un acte authentique, une transaction judiciaire établis dans un autre État lorsque l'application de l'exception de l'ordre public serait contraire à la Charte des droits fondamentaux de l'Union européenne, en particulier à son article 21 qui interdit toute forme de discrimination.
However, the courts should not be able to apply the public policy exception in order to set aside the law of another Member State or to refuse to recognise or enforce a decision, authentic instrument or legal transaction drawn up in another State if the application of the public policy exception would be contrary to the Charter of Fundamental Rights of the European Union, and in particular Article 21, which prohibits all forms of discrimination.
