For example, the Province of Ontario, under the Commercial Tenancy Act, provides for the ability of a trustee in bankruptcy under certain circumstances to assign leases.

Aside from certain specific provisions in the Bankruptcy and Insolvency Act that provide for a specific right of disclaimer, such as in the context of commercial tenancies, the existence of a general right of disclaimer has been left in the hands of the courts to address in Canada.

Second, the rules for disclaimer of commercial tenancy agreements in BIA proposal proceedings — section 65.2, a current provision — are different from the rules of disclaimer of other contracts, which are contained in the new BIA, section 65.11.
