In order to ensure a smooth coordination between the law applicable to the succession and the law of the Member State of the appointing court, the court should appoint the person(s) who would be entitled to administer the estate under the law applicable to the succession, such as for instance the executor of the will of the deceased or the heirs themselves or, if the law applicable to the succession so requires, a third-party administrator. The courts may, however, in specific cases where their law so requires, appoint a third party as administrator even if this is not provided for in the law applicable to the succession.
Afin d'assurer une bonne coordination entre la loi applicable à la succession et la loi de l'État membre de la juridiction de nomination, il convient que cette juridiction nomme la ou les personnes habilitées à administrer la succession en vertu de la loi applicable à la succession, comme, par exemple, l'exécuteur du testament du défunt ou les héritiers eux-mêmes ou, si la loi applicable à la succession le requiert, un tiers administrateur. Dans des cas particuliers où leur loi l'exige, les juridictions peuvent cependant nommer un tiers en qualité d'administrateur même si la loi applicable à la succession ne le prévoit pas.
