She recommends that the government of Cuba take the following measures: halt the prosecution of citizens who are exercising their guaranteed rights under the Universal Declaration of Human Rights; release detained prisoners who have not committed acts of violence; review laws that lead to criminal prosecution of persons exercising their freedom of expression, demonstration, assembly, etc.; uphold, without exception, the moratorium in the application of the death penalty; reform the rules of criminal procedure to bring them into line with the requirements of the Universal Declaration; establish a standing independent body with the fu ...[+++]nction of receiving complaints from persons complaining that their fundamental rights have been abridged; review the regulations relating to travel into and out of Cuba in order to guarantee freedom of movement as defined in the Universal Declaration; authorize non-governmental organizations to enter Cuba; foster pluralism with respect to associations, trade unions, organs of the press, and political parties; and finally, accede to the International Covenant on Civil and Political Rights and its optional protocols.

Main EU concerns are death penalty, detention conditions, co-operation with the UN Human Rights Mechanisms, ratification of the UN International Covenant on civil and political rights, freedom of expression, association and religion and minorities rights.

The Union should ensure systematic inclusion of Human Rights and democracy issues in all dialogues taking place on an institutionalised basis: within the format of the Association Councils (Ministerial level) and Association Committees (Senior Official level) that monitor the implementation of the Agreements, and in other political dialogue formats such as the Troika.

The Commissioner said that the following questions should be examined in the further development of the Charter : - whether or not the Charter should be limited to social rights in the strict sense of the term, or whether it should also cover economic and cultural rights or even civil and political rights; - whether it should enshrine such concepts as the right to an adequate level of physical and mental health, the right to education, to family protection, to minimum income, the right to participate in cultural life and the right to housing, - the righ ...[+++]t of free association and the right of free collective bargaining, a fundamental principle of our common European heritage; - the prohibition of discrimination between EU citizens and the legally resident non-EU citizens in work related issues, as well as the rights of third country nationals not to be arbitrarily excluded from the Union and the right to family union, are also fundamental questions; - the right to non-discrimination on the grounds of race, colour, sex, religion, age and disability must be enshrined in the Constitution of the European Union in a way that is legally actionable by individual citizens.
