The historical and presumptive bias against fathers under the tender years or the maternal preference doctrines, which typically held that mother was not only the parent most capable, emotionally and physically, of parenting a child post-divorce, but the only parent capable of so doing, is no longer publicly accepted, both in the psychological literature and by our courts.
