A. whereas on 6 June 2013 the media reported on PRISM, a clandestine electronic surveillance programme operated by the US National Security Agency (NSA) since 2007; whereas PRISM is a development of a warrantless wiretapping programme revealed by media outlets in 2005 and legalised in 2007 through the Protect America Act and by the FISAA, which authorised mass surveillance –­ including in relation to EU citizens ­– of emails, chats, videos, photos, file transfers, social networking data and other data; whereas, according to the US authorities, two programmes are being run, one on the metadata of telephone communications and the other o ...[+++]n internet and emails, which cannot intentionally target US citizens or foreign nationals legally resident in the US, and consequently have other targets, including EU citizens;

In fact, the legal vacuum created for this category of designated foreign nationals, who are not yet classified as refugees, keeps these designated foreigners in legal limbo for five years, when they file a claim for refugee or protected person status.

44. Observes that the recent EU enlargements have added close to one hundred minority population groups to the fifty or so which existed when there were 15 EU countries, and stresses that because of the low percentage of resident immigrants, refugees and foreign nationals from third countries and the more visible presence of indigenous "traditional" minorities in Central and Eastern European Member States, migration and integration policies have been hived off there from policies on minorities;

For example, in Switzerland there are roughly 1.5 million foreigners with legal residence status and according to a survey by Switzerland’s Central Register of Foreign Nationals in April 2003, 514.250 persons would be affected by seasonal transit.

Secondly, when the petitioner submitted his new passport to the immigration authorities containing the name of his daughter the official responsible kept a photocopy of the first two pages of the document to be filed in the register of foreign nationals.
